Oppositions & Cancellations

Oppositions and cancellations that keep the register clean.

A conflicting application or a registration filed in bad faith can block your expansion or dilute your brand. Acting at the right moment, with the right grounds, is what protects your position.

Why oppositions matter

An opposition allows you to object to a trademark application before it proceeds to registration. It is usually the most efficient point at which to stop a conflicting mark, because the applicant has not yet acquired a registered right and the dispute is confined to the register rather than the market.

Opposition periods are strictly time limited. Brand owners who do not monitor new filings can easily miss the window, which is why we recommend watch services for any brand of commercial importance in Iran and act promptly when a conflicting filing appears.

Grounds we commonly rely on

  • Similarity to an earlier registered or applied-for mark covering identical or related goods and services
  • Bad-faith filing, for example by a former distributor, agent or business partner
  • Reputation of a well-known mark that the new filing seeks to exploit
  • Lack of distinctiveness or descriptive character of the applied-for mark
  • Earlier rights in a trade name or other protected designation

Cancellation actions

Where a conflicting mark has already been registered, a cancellation or invalidation action may remove it from the register. Depending on the circumstances, the case may rest on an earlier right, on bad faith at the time of filing, or on the registration not being used. Cancellation is also a powerful tool in infringement disputes, where the other side's registration is the foundation of its claim.

Patent and design challenges

The same logic applies to patents and industrial designs. A granted patent that lacks novelty or inventive step, or a design that was not new when filed, may be challenged. These cases depend heavily on prior art searches and technical analysis, which we organise with appropriate experts.

Defending your registrations

When your own application is opposed or your registration is attacked, we prepare a structured response: reviewing the grounds raised, gathering evidence of use and reputation, and identifying weaknesses in the challenger's position. In some cases a negotiated co-existence agreement resolves the matter more efficiently than a contested decision.

Frequently asked questions

How do I know if someone has filed a mark similar to mine in Iran?

A trademark watch service monitors new filings and alerts you to potentially conflicting applications, giving you time to oppose within the applicable period.

My former distributor registered my brand in Iran. What can I do?

Registrations filed by agents or distributors without authority are a classic case for a bad-faith challenge. Gather your agreements and correspondence and seek advice promptly.

Can a registration be cancelled for non-use?

Non-use can be a ground for cancellation in appropriate circumstances. We review the history of the mark and the available evidence before recommending this route.
